Regarding a leased apartment & breaking lease. Brisbane Qld.
About 1 month ago, I viewed 3 apartments. 1 on the 4th floor- balcony was too small, 1 on the 5th the balcony was bigger than my current apartment and was perfect! (The 3rd was a hard no) balcony is a deal breaker as I am a single mom, work from home and have a very busy toddler. The one I selected faced the pool and we discussed how I liked that there was a palm tree in front of the balcony for privacy. Perfect. I emailed the agent showing me and referred to the aprt on the 5th floor as the one I wanted. I didn't not take note of the unit # as I only saw one on the 5th floor and trusted that she would remember what unit she showed me. We confirmed and signed the lease shortly after.. again I was not paying attention to the unit # listed in the paperwork. The day of move in - jan 20. I walk into the apartment - this apartment is not one I have ever seen.no balcony. Facing the street. And has only has 1 huge sliding window that is absolutely dangerous safety hazard for my son as he can easily stand In the couch and jump out if he wanted. I talked to management and they denied that I ever saw that balcony apartment facing the pool, and that they don't have that specific apartment as there listing. ?? So the conclusion was either take the apartment 1 year lease or have no where to move on moving day. I have moved in now. And again all my concerns are still there. I want to find a new apartment and break my lease but I can't afford to pay 1. Constant air con for work at home 2. Break lease advert fees & then again a new bond for a new apartment. It was clearly an admin mistake however they are just saying I basically made it up. But how am I - a tenant to know the layout and specifications of an apartment if I never saw it?? … read more

I am looking for some VCAT advice in relation to a sub-tenant in the apartment which I am leasing. I am the original tenant on the lease. I subletted the room with the landlord's permission. I've just had a sub-tenant who moved out secretly without letting me know. The rent and bills were due on the 7th of August. As soon as I notified him of the payment being due, he moved his stuff overnight and left the apartment. Fortunately, I have a $2,000 bond which I took at the start which can more than cover the costs of the arrear payments. I just wanted to get legal advice on what the right process would be before I go on with changing the door locks and find a new tenant. … read more

She is leasing a house with someone from there. The lease is for 12 months. My daughter has been struggling with mental health issues for years. It has been a tough 3 months as she have just recently moved on her own from Adelaide. Being her first time moving out of home, she have recently relapsed back into major depression which she had been struggling with for several years. The house itself is not a safe environment for her mental health which is why she want to move out. A friend recently moved to Melbourne from Adelaide which has really been the light at the end of this tunnel and they've decided to move in together which will really help her with her mental health. Her housemate has told her she will not sign her out of the lease which has made her feel absolutely stuck and don't know where to go from here. Is there any other options for her? Is there a possibility to break the lease? If her housemate does not comply with her is VCAT the only option? Looking forward to hearing from you, … read more
