Good afternoon. I am in receipt of workcover payments. The claim was made and accepted without demur in 2002. Eventually I was classigied as TPD. This entitled me to weekly payments until one year after retirement age and all medical treatment relating to my problem for the duration of my life. I had a nervous breakdown (now labelled non-recidivistic major depression, generalised anxiety disorder, fibromyalgia (from the long-term use of ssri mrdications), etc etc. The upshot is that I'm just going to have to live with it. In NSW the W/C laws changed in 2012 withe new max benefits being five years of weekly benefits and ten years of medical support. In my case, I had to be assessed by an IME (independent medical examiner) and my disability rated over 20% for the existing claim to remain in place. During that five years I had several assessments, all of which placed me at over 26% to varying degrees with two exceptions, both arranged by the insurer. The first was 15%, the assessment held in the (very) elderly doctor's home and he called me Pauline, and used Paulines notes to draw his conclusions. I'm Angela. The second dismissed the initial onset of depression as irrelevant and stated that I am now depressed because I have fibromyalgia and chronic pain. Both of these assessments have been dismissed as outliers and do not speak to the facts. At the end of 2017 as the 5 year of a new claim would have expired, the insurer demanded I undergo another assessment. The report was extraordinary, the conclusions bizarre and the percentage? 20% precisely. This information wasgiven to me just prior to xmas 2017. My lawyer immediately appealed this report in the WCC. Their response was that the doctor was entitled to his opinion. His findings quoted verbatim extracts fr a private investigator's report and was, quote simply, lies. The legal advice I was given was to wait 18 - 24 months and request a new assessment. The wait was to allow sufficient time to demonstrate deterioration in my health. I did this but when I again contacted the lawyer was told they could do nothing as I was only entitled to 2 assessments arranged by my lawyer and the insurer was the same. The last assessment was supposed to simply address two minor issues. It stated that I drive and showed film of me doing so and can I read???? The report gave me a resounding yeď.

Yes. That report caused my weekly benefits to be ceased and my medicals will stop in 2022..I'm 62 and physicslly in good health.. That report was mendacious to tje point of lunacy but I felt it to be the end. I made a decisive attempt at suicide on nre years eve 2017 and woke up in intensive care several days later. That action has left me with some ongoing physical difficulties. FINALLY my question - I know this has been an extraordinary miscarriage of justice and desperately want/need someone to help me remove the assessment from the records, or have another assessment or SOMETHING??? And I want to know if a damages claim can be brought against anyone/someone for putting me in this position etc etc. Sincerely ***** *****.
