Good afternoon, this is david of D W DEAN PTY LTD, we are concrete contractors in victoria, this year i was engaged to do concrete works in tarniet vic for a company called CIVILINK, the work started back in november 2019 and i left the site in march after not recieving any payment, i was eventually paid over a couple of months the first 3 invoices issued based on my rate schedule forwarded to them, this work was done on day rate when we were needed, on the last account civilink deducted varing amounts from the first 3 invoices that were paid to me from the last invoice that was not paid, then they paid my last invoice less some $27,000.00, i spoke with a lawyer recommended from the master builders association and after an initial estimated cost of some $3,000.00 to advise me they have come back with a estimated cost of court action to the sum of $16,000.00 +, so the initional fee of $3,000.00 plus this additional fee of $16,000.00 + totalling aprox $19,000.00 + for a $27,000.00 claim is not possible for me to proceed, especially with the down turn of some 60% in my business as a civil concrete contractor, i have all supporting documents, there is no dispute as to the standard or quality of our work they just have decided not to pay what i quoted and was paid over a 3 month period, can yo help me please, kind regards ***** ***** 360 821 or***@******.***

Lawyer's Assistant: Have you filed a wage-and-hour claim for unpaid wages?

Sorry i dont know what a wage and hour claim is we only invoiced works for each month as we would normally do for all major clients like cpb, john holland etc

Yes and they believe i need to go to court to contest this at a unreasonable cost

Only that the main part of the unpaid invoices are site allowance of which i had noted in my original rate schedule to them and i was obligated and duly paid to all my crew, if they disputed the site allowance on the first invoice i could have either negotiated my hourly rate to cover this or would have been given an opportunity to walk off the job but as nothing was said in relation to the non payment of site allowance and the fact they did pay 3 months of site allowance then deducted all of that from my final invoice,
