I have a sold a property in Qld and the sale got through in late May. We fixed items the buyers requested us to fix. two of the repaired items required electrical power to carry out a functional test, but there was no power available because the tenant had vacated the unit and had rightfully power disconnected. The buyer's solicitors had suggested they keep $5000 dollars of the purchase price in their Trust Fund and the money to be released once the functional check was completed. As soon as electrical power was connected to the premises in June the buyers electrician carried out a thorough check and found the two items of concern regarding the $5000 trust fund to be fine. However they came up with a new list of items to be fixed. Somehow the buyer's lawyers think that we are responsible for this list of new items in the property, which does not belong to us, as of late May. These items were not subject to any agreement with us, and they feel that the cost of rectifying the items in their property should come out of the trust fund. Our conveyancer sent an e-mail asking the $5000 to be returned because there were only 2 items of concern and the other party has refused.. … read more
