I am a salaried permanent employee paid monthly. My employer is classed as essential business during COVID19 and therefore I was instructed to go online and register for the job keeper payment by my employer. The business workload decreased and we are currently only working a four day week. After this happened and I applied for job keeper and working 4 days I was told that I was too use my entitlements (annual leave) as I had too much leave too make up my fifth day of wages. My question is - why am I forced to use my annual leave when my employer is receiving payment for me from jobkeeper. When my leave runs out I have been told I will only get 4 days. I have worked at this business for 13 years. As a salaried employee we have never ‘clocked in/ot' or had any way to track the hours worked. It has just been expected we work long hours. I currently average 12 hours per day .my contract says I'm renumeration is a certain amount per year. Does my employer have to honour my monthly wages even with a four day week and hours now working more over 4 days. So really I have a few questions, thanks Cathy … read more

yes. This employee was full time prior to covid 19. I have a hair salon and closed my doors for approximately 4 weeks. I have this employee 18 days notice that I wanted her back at work for 30 hours as at the first week in May. In the mean time she picked up a second casual job and asked me could I work around the roster for the second job in the short term. I did agree (I was too nice) but when I worked around the roster I could only really work her for around 25 hours a week. I sent her a written roster which she agreed to. Over this month I did a lot of homework and discovered that I could 1. Make up the shortfall if hours out of her annual leave and 2. I could accrue her leave at the rate of the actual hours that she was being worked or paid for not at the 38 hour contract she had originally. I suggested this to her and she threatened to take me to fair work. I have also recently discovered that she had shortened her hours/days up without asking me and marked herself out in our system as unavailable. I questioned her about it and she lied to my face and said that I had agreed to the changes. I absolutely did not. I have also had another team member tell me that she had confessed to them that she was doing cash hairdressing at home. So I questioned her about that and gave her an option to resign which she denied. Tonight I emailed her with a letter (provided by our hair and beauty federation) requesting that she explain her absence on the hours in question and she replied saying that I allowed it which I insist she did but. She is now saying I am bullying her into a resignation and I have no choice but to ask her back to work for next week. Please help me! Can I reduce her hours? Obviously she will still get the full job keeper allowance but she is so toxic ATM that I want her in salon at least as possible.… read more
