On December 4rh 2019 I commenced custody/parenting orders in the family law court.I am the respondent in this matter and I have been ordered to undergo hair follicle testing which must be done by the end of next week (beginning20/01/2020).Both parties were instructed to undergone the drug testing.The next Court appearance is Feb 2020 and I must have my affidavit of response to my solicitor by 29/01/2020.My son is 9 years old plus I have 2 other kids 17&16 to another father ,who I have had full custody of since 2005 and raised as a single mother.My son revealed to me in July 2018 that he no longer wanted to go to his dads or have a relationship with him at all -ever.He told me that his father had done inappropriate things to him of a sexual nature and he was extremely upset.His behaviour had been obviously increasing in angry outbursts which were frequent and very nasty and painful to himself and for me to witness.I could see& feel his pain as his entire personality at age 7 ,had changed totally and he was confused ,angry ,hurt and broken .I was so sad and felt so helpless for my baby .
I reported this to police and the Jert Squad was to begin an investigation .My son after two interviews did not voluntarily disclose any useful information to keto the investigation going do it was put on hold until such a time that the information needed was there to further investigate my sons father.I was able to record on my phone on two occasions the conversation between my son & I when he bravely told me why he no longer liked his dad etc and I gave this to the police also .
Because of the circumstances i have explained from 2018 I did dabble in drug use to block out the pain of what my son ,myself -my family(me&3 kids)we’re living through.
I have my own personal training business as well as worked 5 days per week at a gym ,this has changed since but am still self-employed.
Unfortunately after submitting my applicant papers for custody and at risk forms at family law office in August 2018 ,i received a possession charge having had .07grms of ice on the floor of my car and two positive drug swabs tests later in Jan 2019& April 2019 .I was devastated as I couldn’t file for custody until the pending charges were dealt with.
By Oct 2019 all matters were finalised and I would recommence filing for custody by 2020.17/10/2019 a friend was in my garage gym training as usual and another male known to us entered my garage and began to attack my friend with a machete.He was cut in 3-4 places and the accused was caught and jailed by early the next morning.
This was the senario that gives reason to the applicant father applying to the court for custody/visitation rights etc.
I have a solicitor but I’m not confident with him as I have no correspondence since the mention date back on December 4th 2019 .What can I do regarding the drug testing ,the solicitor ,the alledged sexual assault etc.my son has been appointed a solicitor by the courts and I’m not sure what or when he will use this solicitor because he wants to tell the solicitor about the reasons why he doesn’t want to see his dad and why he hasn’t wanted to know him since July 2018
