50% of my role has been taken on by another new role in the
50% of my role has been taken on by another new role in the organisation without my knowledge, consent and without the ability for me to apply for the role. I have not been offered any other roles but just kept in the same role. I was appointed to the role about 3 months before the new person started. I feel that my employer has broken trust and also made my previous role redundant as it no longer exists in practice even though my title has not changed. I am looking to be made redundant from this employer as there would be no other roles in the organisation that would carry the same level of duties. I am keen to understand what my rights are and my chances of successfully claiming a redundancy payout? Thanks … read more

Hi Pearl, sorry I didn't realize that hitting enter sends the message. My Name is*****'m from South Australia. The reason I'm contacting you is that I have been made redundant as a Marketing manager at Head Office at RMD Australia. The Managing Director said that my role would be replaced by the Marketing Department in the UK, so it sounds like they are replacing me. Could you please tell me if this would be a valid case and how much does it cost if I lose. Thanks, Phil … read more

I was given notice by my employer before Christmas that I
I was given notice by my employer before Christmas that I would be made redundant effective 28 February. They then asked me to stay on until the end of March, to which I agreed, and again asked me to stay on until 30 June, to which I again agreed. They sent me a revised notice of redundancy effective date, payout figure etc. I have now been offered a new job with another organisation, and need to understand whether, by giving 4 weeks notice (though Employment Agreement only specifies 3 weeks) to my existing employer now, will I lose my redundancy payout? Obviously, I would lose the 'payment in lieu of notice' component, by working out my 4 weeks, but I would not want to lose my 8 weeks tax-free redundancy payment - this could affect my decision whether or not to accept the new role. … read more
