In 2007 my now 93 year old Mother Hazel Gurski appointed her two daughters Desley Lynn Storch and Barbara Jill Peterson as joint Power of Attorneys, Mum has been in the Forest View Nursing home for the past 3 years and has not made a decision about her care or her finances in this three years, sticking point Mum had a key card which Barbara has had in her possession since 1st September 2017 i Desley requested card to buy Mum new cloths 28/11/2019 spent total $348.30. as i live 600km away from Wondai. when i left Kingaroy where Barbara and my brother live only 30km from wondai i left the card with my brother Colin to pay for a portable oxygen cylinder so Mum could go out without fear of becoming breathless due to a medical condition. Barbara asked Colin for the card back, he said he needed it, Barbara went to the commonwealth bank and cancelled the card, which we have been using in the belief we were able to do to look after our mother. unfortunately this turns out not to be the case, Bank manager states we were using card illegally. In Mums power of Attorney document page 9 clause 5 box ticked is On this occasion :"from such time as i become mentally of physically incapable of carrying on my affairs" Clause 7 States "Jointly " As previously stated i live 600km away from where Mum is and cannot just pop into the bank to sign withdrawal slips and am wondering if there is any way around this situation Signed Desley Storch

There is some history to this account Barbara's Daughter was charged with steeling in excess of $60,000.00 from this account and ultimately pled Guilty. I beleive this is part of the reason Combank are reluctant although there have been no unauthorized withdrawals from this account since thieft was discovered

John I cannot day how disappointed I am in this service. My first and last use. The information I sent was obviously not read, clearly states Enduring Power of Attorney wording I was enquiring about. Your first question is about copy of the will. Hello will was not ever mentioned. Please cancel my account 22566899-310 and discontinue any action or advice. I require confirmation that I will not be charged any further money’s from this company Regards ***** *****

I appreciate your comments, and understand that your matter relates to enduring power of attorney, however an important aspect that is associated with the enduring power of attorney, is also was there a last will and testimony, as this is an important document that can have an impact as your matter moves forward?
