My question is regarding a car accident where I was not
My question is regarding a car accident where I was not insured but the other party was. In my opinion (and I show evidence) the other party was at fault, I had witnesses approach me immediately after the accident and offer their details. I received a letter from NRMA (the other party's insurer) stating that according to their member I was at fault. I gave them my versioon of events and details of my witnesses. they replied that my witnesses could not be contacted and are not filling in the required form. Finally i received a letter from NRMA stating that due to lack of information they will not pursue me for repair cost to their client's vehicle. I am being ripped off by NRMA for no fault of mine. (the other driver was illegally on the wrong side of the road when he hit my car) my question is: how can I get NRMA to listen to my side of the story? even if my witnesses are refusing to get involved (i tried calling them and they're not picking up ) it is obvious if they look into it. … read more

Pearl, I have contacted the Police in Sth Mission Beach. They say its not a re portable incident and that its a civil matter. They advised me to contact you to clarify if we should automatically be at fault because my wife opened the door. My wife has paid the $1,000 excess as she did the claim over the phone and was rattled by the accident. Since this policy is in my name I'm trying to fight the"at fault" claim. Recently I was filing my car in a service station in Cairns. My wife opened the door approximatley 8 inches and a vehicle hit us. He was travelling from the Bruce through the forecourt area to park at the shop to pick up something. No fuel. There was adequate room as there was no car on our left [passenger side]. There was no one injured and his ute tray had zero damage. I write to you as our insurance company has deemed us at fault by simply opening the door just ajar. We have a witness who will attest to the ute driver's excessive speed and also there will be a video from the station that Budget Direct could view and ascertain exactly what took place. Can you please clarify Budget Direct's position and confirm that we do or do not have any recourse. That there ruling is correct even though they haven't investigated the accident. That by opening the door we are at fault, no matter what the other driver was doing.I have photos of the door and it is evident that it wasn't open very far. The insurance company are not interested.
