Do you have a copy of the contract?
When did you sign the contract and did you have the rental car when they sent the email?
Ok
Because you did not dispute the change in the excess you are stuck with it.
Had you refused to accept then you can argue there was not agreement.
In relation to the other party do you have their details?
Is there any admission of fault?
You are going to have to pay the excess and then su him for the money.
The contact you have has been amended and you are liable to pay for the excess.
The insurance company of the rental is not going to do anything to assist you to get this back. They will sue down the track when they work out the time they have lost rental on the car because it was in for repairs.
If you have his details you can send him a letter of demand for the excess and if he does not pay then you will have to start proceedings in the Magistrates court and seek an order for the excess and the filing fee interest and also any legal fees you pay in the court process.

You have to chase him up and also get details of the insurance company he has.
