Second opinion] We wish to buy an Agricultural property in Victoria. We being Foreign company (India), ONLY if the land is classified as “Agricultural land” , it can be bought by us without seeking FIRB approval.
We sought FIRB's opinion by sharing the details like the property being in "Farming Zone". They have said that we can be reasonably certain that the property is Agricultural but also advised to seek a legal opinion as they do not give definitive advise.Comment from FIRB are in bracket and Quotes:""{ Is the property currently being used for primary production purposes? That is, is there a primary production business currently operating on the property that is taxed as such for Australian tax purposes?If it is, then you can be sure that the land is classified as agricultural land under the Foreign Acquisitions and Takeovers Act 1975 and as such will be below the notifiable threshold as long as the company does not own any other agricultural land in Australia.If it is not, then you will need to look at the zoning of the land and the nature of the titles and seek independent legal advice as to whether the land could also be considered residential and/or vacant commercial which have a zero dollar threshold. If so, the acquisition may need foreign investment approval.}"The facts : The property is in a Rural property in “Farming Zone “ in Victoria state. The size of the plot is 111 acres and has one dwelling of 4 rooms, two halls and a kitchen already constructed. It is being used to keep few sheep (25 in number) for wool production and grow grass for grazing of neighbor’s sheep. Though no official agreement exists with respect to charge for grazing of neighbor’s sheep.We need you advise with respect to para-3 based on above facts TO BE CERTAIN that if the document says : PLANNING ZONE = FARMING ZONE (FZ), FIRB will definitely consider it as "Agricultural land" we can go ahead with the purchase of the land.
