Hello, I am a...

Hello, I am a landlord and had rented my house to tenants.when the tenants left the property they failed to disclose to us a leak in the kitchen, Rangehood not working and a switch unit with a crack line.I as the landlord had it all repaired to the total cost of $1,275.00. The tenant is asking for the $800 bond back but we have not yet demanded anything from them only that $800 bond will be used to cover above costs and there for he will not be receiving the bond.My mistake also here is that i failed to lodge the $800 bond to the RTBA.Please guide with the correct legal solution of what i need to do next? Thank you

Was the rangehood working when they moved in?

Did you do a post tenancy inspection with them to make sure that the premises were in the same state and condition as before?

Have you notified them of the issues and that they are liable and the cost to get the repairs done?

The leaking tap how do you know the tenant was aware of it and failed to tell you?

Has it caused damage? Have you got insurance?

If they have caused the damage they are liable

You should get written reports and then send them a letter of demand.

Refuse to give the bond back and seek they pay the difference. If they refuse then you have to sue them in VCAT so that you get the bond and also they pay the difference.

But you have to be able to show they caused the damage and it was not fair wear and tear. If it is fair wear and tear then it is not their liability and you have to pay and may have to claim on your insurance.
