I am wondering if I should take out a complaint against our
I am wondering if I should take out a complaint against our landlord in VCAT. We have a five year lease on a warehouse and there has been an issue with a controlller box on the roller door of the warehouse. The lease states that this is part of the Landlord's "installations" and section 6.2.3 of the lease states "breakdown of landlords installations"under the general heading of Landlord's Obligations. The agent is being difficult in not answering specifically why this is not appropriate only responding Replacement of the contactor box is a building operating cost which will not be covered under any insurance policies, regardless of whether it is a landlord's installation or not." Pearl. Pearl, Pearl, I have contacted the Police in Sth
Pearl, I have contacted the Police in Sth Mission Beach. They say its not a re portable incident and that its a civil matter. They advised me to contact you to clarify if we should automatically be at fault because my wife opened the door. My wife has paid the $1,000 excess as she did the claim over the phone and was rattled by the accident. Since this policy is in my name I'm trying to fight the"at fault" claim. Recently I was filing my car in a service station in Cairns. My wife opened the door approximatley 8 inches and a vehicle hit us. He was travelling from the Bruce through the forecourt area to park at the shop to pick up something. No fuel. There was adequate room as there was no car on our left [passenger side]. There was no one injured and his ute tray had zero damage. I write to you as our insurance company has deemed us at fault by simply opening the door just ajar. We have a witness who will attest to the ute driver's excessive speed and also there will be a video from the station that Budget Direct could view and ascertain exactly what took place. Can you please clarify Budget Direct's position and confirm that we do or do not have any recourse. That there ruling is correct even though they haven't investigated the accident. That by opening the door we are at fault, no matter what the other driver was doing.I have photos of the door and it is evident that it wasn't open very far. The insurance company are not interested. Regards ***** *****(###) ###-####… read more
