Good Morning,

are you suggesting that when you try fell underneath the car that it was a result of something that the dealership had done to the legal when it was with them?

You are going to have to take the car to another dealer and get a detailed report as to the causes of the problems and if the car was purchased new it may be still covered under the Australian Consumer Laws if the issues are a manufacturing fault.

This means that under the Australian Consumer Laws they must repair the vehicle as it is a manufacturing fault and it does not matter whether the warranty period has expired.

if they refuse to do the repairs and it is an issue that comes under the Australian Consumer Laws then you will need to commence proceedings against them in NCAT.

The fact that they claim they are not an offer I my own dealer any more is irrelevant. They would have the expertise to repair the vehicle they are just simply fobbing you of so that they don't have to deal with the problem.

But you will need to get an independent mechanic to provide you with a report as to why the problems have occurred and whether they are responsible when they service the car.

I would suggest that you draft a very detailed statement with everything that has happened to the vehicle and your experiences with the dealer as this will be required down the track.

When dealing with telephone calls or face-to-face conversations, you should set out to the best of your recollection there you were talking to, the date and what each party said and place it in conversation.

You have to notify them of all of this.

The statement you prepare you can send it to them and request they repair the car and if they do not then you tak it ti NCAT.

The more evidence you have the better your case.
