Residential tenancy agreement nsw. The landlord increased the tenants rent significantly above market rent by $125 and subsequently $200 above market rent when the tenant asked the landlord for consent to run their council approved homemade childcare service from the rented property. The landlord new the tenant needed to stay at the rented premises to run the business as the business needed to stay in close proximity to the local school where the tenants clients children attended. The Residential Tenancies Act 2010 is silent on whether a tenant requires consent from a landlord to run a home base business therefore the tenant was not obliged by law to request consent as long as the tenant was not breaking any conditions of the lease which they were not and the business was council approved. The tenant in return for paying the landlord the courtesy of obtaining consent found the landlord decided to capitalise on the situation and initially demanded a share of the profits of the business. When the tenant declined as the education department would have become concerned the landlord than increased the rent initially by $125 pw above the market rent in in return for consent to run the business. The tenant was a new migrant at the time and did not know her rights in relation to the consent from the land lord and her tenancy agreement did not inform her of her rights in the matter.
My question is the landlord raised the rent during the 6 month term of the fixed term agreement when there was no provision in the clauses of the agreement to do so and did not provide the tenant with the sixty day prior notice of the amount of the agreement or the date of the increase all in breach of ss 41,42 residential tenancies act 2010.
The landlord than had the tenant sign a new lease before the initial lease six month period had expired.
It appears there has been a significant breach of both lease contracts as the second lease could not commence for the same property while the first lease was in operation.
Would both leases be considered breach of contract and void or voidable and the tenant able to take the matter to the nsw local court for compensation
