As your father had full comprehensive insurance he is covered and Suncorp should not be contacting him and stressing him out.

On behalf of your father forward any correspondence from Suncorp to RACQ and they should deal with this issue.

You will not be charged any legal fees as this is all covered by your policy and your father would have already paid the excess for the accident.

You should also inform Suncorp that RACQ has carriage of the matter and that they should forward all future correspondence to them as your father was comprehensively insured.

If this matter is to go to court over the disputed value of the vehicle, your father may in the slimmest of circumstances be required to give evidence to confirm how the accident occurred, but the insurance companies will rely on expert evidence relating to the value of the car that was damaged by your father and then the court will decide on what I fear amount is.

You need to call RACQ and advise them about the threat for a default judgement and obtain details on whether they have filed a defence with the court. If you have the court papers you can also call the court and check to see if I defence has been part of your father to protect him.

But RACQ are the ones that must be doing the work at no cost to your father.

If RACQ have said to you they have filed a defence the court will confirm this.

The other side cannot get default judgement if RACQ have filed a defence.

If the defence is filed they cannot get default judgement and RACQ are running the matter for him. Ask RACQ for a copy of the defence.

The lawyer for the other side would have been appointed by suncorp.

But RACQ have to pull their finger out and file the defence.

They have to file a defence ASAP

If a default judgement is grated they can chase your father for the money and even seek to get orders to take money from bank accounts.

RACQ are being negligent not doing this ASAP
