They cannot bankrupt you unless they have judgement against you.

Go to court Friday and ask the magistrate for an adjournment and explain that you had not received anything.

Also seek an order to be allowed to access the file and you may have to file a defence.

You need the time to get this done correctly.

You will need a solicitor to assist you with filing a defence and proceed to try and resolve this.

But the court will grant you the adjournment.

You need the contract to be able to determine what your defence will be.

Because you have never been served you seek orders from the Magistrate to access the court file so you can see what has been done.

If the Bankwest contract says that you are liable for the costs of selling the debt then yes.

But you have to see what the contract says.

If you dispute the charges and the contract does not have them in it then you can seek that court dismiss them.

But you need to see what you have signed when you entered the contract.

They too can only enforce that.

If they have judgement they can issue you with a bankruptcy notice. If you do not comply and pay the dent then they can have the court declare you bankrupt and anything in your name is ***** *****
