First of all, my apologies for the length of my question. You may want to put the kettle on and settle into a comfortable seat before continuing. I recently purchased a Kogan Atlas Mini PC via the Kogan online website. I was hoping to use it as a replacement for a laptop that is connected to my TV. The Atlas box is a great deal smaller than my laptop and supposedly a lot more powerful.
The PC arrived on the 19th of June and after installing the machine I had problems using a remote mouse. The mouse would only work within about 6 feet of the box. Prior to purchasing the Atlas PC, I was using a remote mouse on the laptop and it was fine up to 8 metres.
I contacted Kogan and was told there could be drivers missing on the PC and I should download the necessary drivers (which I had already done with no success) and try using the mouse again. I did this but the remote mouse still wouldn’t work. I contacted Kogan again and was told to try using other mouse devices to see if they worked. Once again, I had already tested three different mouse devices, but none would work outside the 6 feet range.
On the 20th of June I was still testing the machine when I received a Windows 10 message saying that there was insufficient space on my Atlas PC to carry out any Windows updates. I checked the hard drive and started to uninstall any unwanted software but was still unable to make enough space available for updating. I decided to have a look through the FAQ on the Kogan and found that I am not the only customer with this space problem.
At this stage I decided to contact Kogan and tell them I wish to avail myself of their “14 Day Change of Mind” policy and return the PC to Kogan. This policy was displayed as being available for the Kogan PC at the time I ordered it. I didn’t receive a reply. There is a “Chat online” option on the Kogan support web page but when I tried to use it I received an “unavailable” message. I then tried to locate a phone number for support on the Kogan website but I don’t think one exists. I even tried the Kogan Corporate website and once again couldn’t find a phone number. All communications are via emails.
So, every day I have sent an email to Kogan support asking for the return address but as yet have received no information. I did get one reply which stated that my request has been passed on to a senior support person and has been given a high priority. All I want is an address..!! I suspect I will eventually receive a reply after the 14 day period informing me that the offer has expired.
I have since read the Kogan “Kogan Returns Policy Terms & Conditions” and I now know, if I return the PC, I won’t receive a refund for the purchase price, just a store credit for the purchase amount. This is what it states: “At Kogan.com, we stand behind Our product! That's why we offer a 14 Day Change of Mind Guarantee on all our Kogan.com Exclusive Brands, which are Kogan, Komodo, Bubbli, Certa, Ovela, Cookmaster, BellaVita, Fortis, Vostok, Scharfen, Pestill, Ergolux, Orbis, Estelle and Kromo branded products. If for any reason You are unsatisfied with Your purchase of a Kogan.com Exclusive Brand product, you can contact us within 14 days of taking delivery, and organise to return the Product and receive a store credit for the purchase price of Your Product (excluding initial delivery charges).”
Is this legal? It would seem that Kogan can sell anything they want and, if the product doesn’t work or is sub-standard, Kogan isn’t required to refund the purchase price. And, by offering a store credit, Kogan is assured it will never lose any funds when a product is returned. Bad luck for the unsuspecting customers who don’t require anything else in the Kogan store, but purchase something they must, just to break even.
