In the family law...

In the family law court a decision was made to over turn a decision of a Magistrate ....we would like to know who does the Judge in the family law court have to answer to.

Lawyer's Assistant: What steps have you taken? Have you filed any papers in family court?

The mother had not been informed that the case was going back to the family court, her solicitors had not told her that this was happening and the Judge over ruled the Victorian Magistrate ruling of 3 weeks with the child ...until she could get a new Solicitor to advise her,,now the Federal Police have just taken the child into custody.

Lawyer's Assistant: Family law varies by state. What state are you in?

The original action was in NSW but now she lives in Victoria.

Lawyer's Assistant: Anything else you want the lawyer to know before I connect you?

There is a arrest warrant out on the child father for abuse and rape ...ex bikie with gun and affray charges. Would anyone in their right mind give joint custody to a father like that and his Mother who knew these things had occurred.

In relation to your important matter, the Family Court appeal will be set by the Court itself with a full bench, meaning more than oner judge such as 2 or 3 generally.

Where your lawyer has been negligent you will be able to raise a claim against that party.

You can file a claim to the legal services commissioner.

Thank you. My grand daughter has an appointment on Monday with a Solicitor, unfortunately the child has been taken by Fed Police and given to the Paternal grandmother. The father of the child has been bailed to appear in Victoria in 2weeks ...I fear that they will now abscond overseas...they are Iranian and have previously stated they will get her out of the country. I am the child’s great grandmother and very distressed. I would rate your efforts 5* Star. Thank you again.
