Hello,

Lawyer's Assistant: Hello. How can I help?

As the proprietor of a small medium size business about 30% or our debtors have put us on 60> day payment terms and this is having a significant impact on the business cash flows.

Lawyer's Assistant: What state are you in? And have you consulted a local attorney?

Nsw and no at this stage. Minister for small business Craig Lundy suggested we speak with the ombudsman for advise

Lawyer's Assistant: Has anything been officially filed? If so, what?

No. Not sure how to handle this matter without loosing the respective customer business.

yes you can speak with the Ombudsman, but one of the positive ways to work with debtors is to enter into short term agreements to accept payments in smaller amounts, as this will allow cash flow to come in.

this is positive way many businesses operate todays society with a tight clash flow.

all that is requires is a simple form agreement.

another point you can consider in conjunction with this agreement is taking part payments by credits.

No. I have received a letter of demand for an outstanding payment which I have been paying off a liitle at a time because the big supplier abandoned us & put our business into a state of financial duress. The 2017 contracts came with a wholesale price list that was 10% higher than our competitors. We refused to sign it because the numbers didn't work. They parted ways & it has been bad. I am trying to wind the business back gently so everyone gets paid, but it has to be on my terms because we don't have the cash flow to splash around. I believe they are being unreasonable & they are using threats of legal action to intimidate us. The remaining debt is just $1800. I made a $100 payment on the 8/7/17 & 24/7/17. The letter says it has been outstanding since May 2017. Before that I made payments through June & May & have cleared all invoices except this last $1800. This big company made $92,000,000 profit last year, have driven us to near failure have not made any human contact since. I received a whinging complaint that I didn't return stock using their preferred guidelines & this letter of demand. I believe the letter is a heavy handed bluff & that whilst ever I make an effort to pay down the debt they don't really have cause to instigate legal action that will cost them more than $1800.
