Hi my son is...

Hi my son is 3 year old I wanted to put him 3 year kinder so I went to good start early learning they asked me birth certificate . I provide them my son’s birth certificate and then they didn’t informed me that they don’t have 3 year kinder service . They just put my son in 4 year kinder and they asked me to pay $100. Which I have paid and last year my son just went one day and they direct debit from my account $452 . I asked them to give my money back because my son didn’t went there. But instead of that they sent me recovery letter to pay more $122 .please help now everyday am calling them and they answer my phone.

Did you sign anything with them?

Did the document refer to anything relating to what you had agreed being a 3yo Kinder service?

What you signed did you consent to them taking the money?

Do you have the agreement you signed with them?

Good Morning

If you specifically asked them if they provided a service for 3yo children and they indicated they did, and they did not then you have been mislead.

Whether he goes one day or not, what you have signed has given them the right to charge you.

Having said that with them misleading you, they have breached the Australian Consumer Laws and you have a right to get your money back as they cannot provide the service.

Here is a link from the ACCC that sets out the law in Australia as a whole

You can send them a letter setting out how you were mislead and that they do not provide 3yo Kindergarden services and that they have breached the law.

If they do not refund you then you will take the matter to VCAT

VCAT deals with these matters in Victoria

They cannot provide the service and therefore they should refund your money and the law is on your side.

Hopefully it will not have to go to VCAT.

You are entitled to a refund based on the fact they lied to you

We have a “friend “ who was a surrogate for someone else who decided 2 weeks before babies birth that they didn't want to be parents. We were then contacted asking if we would take him (I cannot have any more children - we have 2 daughters already) and of course we said yes. We were living in Tasmania at the time but I hoped on a place to be there for his birth. He was born via c section on 15 May 2017. I was in the room for the surgery. Right after birth he was placed on me for skin to skin contact. I did all the “mum” things, eg feed him, bath him etc. on 20th May 2017 I flew home with him back to Tasmania. My husband Adam is on his birth certificate. We made a silly decision last year to move here in March 2018 so baby could have a relationship with birth mum. We moved before doing the parenting order. On Wednesday 16th May 2018, I dropped all 3 children off to her while I had a medication change (I wanted to wait until my husband arrived as he didn't arrive until 24th May 2018 but she talked me into doing it before he arrived) but the medication change ended up as a suicide attempt. I was on a medication for bipolar that I shouldn't have been on so now the doctor has taken me off it and I've now made a full recovery and will live a normal healthy life. She told me she would look after all 3 children until my husband arrived. While I was in hospital she contacted child safety services and then convinced my 14 year old to tell them I bash her. Child safety have given our 9 year old back, placed our 14 year old in foster care while they finish their investigation, and they said they can't do anything about baby and we need to take her to family court. Apparently because there's no court orders she can just keep him if she wants? Does that mean if we can get him for a visit we can just keep him until court because there's no court orders? We need help getting our son back … read more

My ex husband died last week in hospital from muliple cancers he and I divorced over 25 years ago and I remarried. When I visited him in hospital in Ballarat he said I was the beneficiary of his will. I was surprised. However only 26 hrs before he died a neighbour got a solicitor to go to the hospital and he made another will leaving the estate to charity and making his neighbour the manager of it.
