I signed a contract with Goodlife gym. They omitted to tell…

No flyer. They had a discussion with me and only spoke about the monthly fee and the "discount" I would receive in the monthly rate if I signed up in Dec. Never mentioned the once-off admin fee. They then used a mobile tablet to fill out questions on the screen and I signed electronically (using a touch screen). They then sent via email the printed contract. When I got home, I checked and saw the admin fee for the first time. I went back the next day and complained. This was in Dec just before the holidays. They said they would get back to me as their manager was already off on leave. They never did. In early Jan I went back and did one session. The change room was crowded (they oversold membership) and the locks on their lockers in the change room do not work properly. In the next day or so, I returned all the gym member tags and also hand delivered a written note to cancel. It was outside the 14 days quick cancellation period (due to the xmas holidays and that I only intended to use the gym at work in the city).The debt processing and collection is handled by DebitSuccess, and they keep demanding money. I mentioned that I had cancelled the contract, and that the original contract was signed under misrepresentation.They actual fee owing is not important, I am taking a stand due to the morality of having entered into a contract that was misrepresented.

From what I can determine - the processing firm has not actually deducted any money from my account, they just keep hounding and threaten me so that I pay. It is bordering on harassment.My question is how do I get them to stop? Part of the difficulty is that the Goodlife gym has obviously decided to let DebitSuccess act as their "hound dog". If fees were in fact deducted - I would claim for the return of fees under an "unfair contract". I have written to both Goodlife and DebitSuccess instructing them to cease and desist from contacting me - but DebitSuccess keep sending me emails and threatening me.I hope this make my situation clear.

Hi JohnI will give the issue a few more days - and if I get any further emails/correspondence, I will collate all the docs I have received, do a time time of events and then get hold of you. Can you please let me know how much any further action on your part (i.e. document review, writing letter etc) will cost?Thanks

Hi JohnI am still being hounded by DebitSuccess. Can you please let me know how much it will cost to draft 2 letters, one to Goodlife and one to DebitSuccess? In the interim, I will start preparing PDF versions of their docs.Thanks
