Firstly I would suggest you have a solicitor represent you in this matter.

Also you will need to get yourself references from employers and close friends to show this is out of character.

If your record in the last 10 years is good with no offences, there is a possibility that the court may be willing to give you a section 10 no conviction recorded.

These are not given out easily and it will all depend on what the court is told about the event, the references and if they are convinced that they should be lenient.

Only of they grant you a section 10 will you be able to retain your licence and not be disqualified.

The maximum penalty for a first offender is imprisonment for 9 months, a fine of 20 penalty unitsand automatic licence disqualification for 12 months.
In your case as it has been more than 5 years this would be viewed as a first offence. so the disqualification will not be greater than 12 months provided there is no aggrevation, eg you caused damage to any property or an accident.

If the court decides to be lenient but is not prepared to issue you with a section 10 then they can reduce the disqualification period. In most cases they issue 6 months.

But you will need to be represented and you should appear in court. If they have given you the option of sending in your plea and not appearing, do not take that option it will not be in your favour.
