I have a question about the Australian child sex offender…

Second opinion] Hi, I have a question about the Australian child sex offender register in NSW. If a foreign national from Switzerland with dual citizenship (Australia and Switzerland) has been convicted of a child sex offence in Switzerland, while living and working in Switzerland, but plans to take a holiday in Australia for less than 30 days, is he/she able to enter and leave Australia for the purpose of that holiday?He/She is not required to report to local authorities in Switzerland and is permitted travel overseas (has already travelled overseas for holidays once, but not to Australia). He/She was sentenced to pay a fine for the crime, which is paid in full, but NOT to a prison term. He/She is still on parole at the time of travel and for a few more months afterwards, but has no local reporting resposibilities or travel restrictions. He/She is presumably registered on the Swiss criminal registry. Is he/she then also automatically entered onto the child sex offender register/ criminal register in Australia or NSW and so barred from entering or leaving Australia for a holiday?Also, does the new law barring registered child sex offenders with reporting obligations stop this person from leaving Australia after his/her holiday?Would the Swiss government have notified the Australian government about the crime?Thanks you for your response.

Good Afternoon

As an Australian citizen they have no problem entering Australia as they will be entering as a citizen and not on a visa.

They will not be refused entry and they will also not be detained.

There would be no reporting in Australia unless he has been convicted here in Australia.

If he has reporting obligations in Switzerland then he has to make sure they allow him to come and not report in Switzerland. If they decide they want him to report in australia then there has to be a court order and the Swiss authorities have to seek the consent of the Australian Authorities in the state he will be in to report there.

Aside from that he can freely enter as he is a citizen.

HI Leon, Thank you so much for your respone. Let me just clear two things up quickly:1.) So, if this person enters Australia on an Australian passport and thus does NOT have to admit any previous convictions on the passenger entry card, there is no way the Australian government would know about these convictions? Also, the Swiss government would not have relayed information about the conviction to the Australian Government? And even if this is not the case, the person can enter and leave freely as there is no reporting in Australia as he/she was convicted in Switzerland? There are no travel restrictions or reporting obligations under the sentence of the crime. This person has travelled before without problems, to indonesia for a wedding.2.) The specifics regarding the new law barring child sex offenders with reporting obligations from leaving the country would NOT affect this persons return to Switzerland?3.) Would this person, regardless of trouble at the airport, be on ANY Australian criminal register, if he/she was convicted in Switzerland for this crime?Thank you so much.
