During our build Masterton allowed the particle board

During our build Masterton allowed the particle board subfloors to be under the elements for about 6 months. Australian building standards put the maximum exposure to 3 months. Even under 3 months they require drilling of drainage holes to remove any ponded water. If the 3 months exposure is exceeded, the standards require the particleboard-flooring manufacturer to be called upon to provide a written opinion as to whether the floor is satisfactory. In spite of my numerous demands Masterton did none of these. The only thing they did was spot sanding of the edges of the panel. This did not make them levelled, because they bended too much and there is a limit on how much sanding is allowed to avoid impacting the structural integrity of the panels. As a result of this Masterton’s negligence, the floors were so uneven I had to pay $7,175 to the floor installer to put a levelling cement on almost all areas of the particle board subfloors. This resolved the uneven floors issue, but now our floors are creaking when walked on.
I am seeking Masterton to pay me the loos of $7175 due to their negligence.
Not sure what I can claim for the creaking floors. Ask them to replace the particle boards upstairs and re-lay the bamboo flooring? That would be a hassle as we will not be able to use the upper floor for a long time. The impacted area is also in two bathrooms, which will require re-tiling if the particle boards are to be replaced.
Compensation? Not sure how can I calculate the loss for having the creaking floors and the underfloor, which may last much less compared to the floors, which were done according to the standard.Attached I have an email to our Construction Coordinator to make her action the issue.
