My partner and I purchased an investment property and the mortgage is in both names. However the title has me having 90% ownership and my partner has 10%. We did this as I needed more tax-write offs at the time. The roles have now reversed and I want to out my partner's name on the deed/title as 100% ownership for tax purposes acknowledging we both are responsible for the mortgage payments. Is this possible? Queensland, My ex husband has had a carer looking after him
My ex husband has had a carer looking after him in his current home for 7 years. He used his first home owners grant so put the title in her name. He also used non repayable monies given to him by DVA. The mortgage is in his name, title is in her name, he pays the mortgage. The Current Title Search has no Joint Tenants or Tenants in Common on it. He has just suffered his third stroke My question is if his estate goes to our children they would then be responsible for the debt, if they cannot pay the mortgage & the carer owns the home by Title what happens. Thank you Julie … read more

I've almost completed the conveyancing work for the sale of
Hello Pearl, I've almost completed the conveyancing work for the sale of my house, and have not engaged a solicitor in the process. However, I do have an agent who has organised the contract signing and deposit etc. Settlement is set for two weeks time and I have arranged with the bank the details for the day. I have a small mortgage on the property and the 'Request to Vary Security Form' is completed and with the bank. Transfer documents have been completed and are with the buyer's solicitor. I am preparing the Settlement Statement but before I send it through to the buyer's solicitor, I wish to clarify the requirements/process of the mortgage release with the Titles Office. I sold a different property about 12 months ago and in that Settlement Statement subtracted the cost of the mortgage release from the amount payable by the buyer. But I don't recall completing a Form 3, and it appears that this form requires my endorsement. Can you please confirm the process for me. Thanks, Garry … read more
