An insurance company accepted...

An insurance company accepted a claim and took the excess then 2 months later when repairs were being done came back and said a clerical error had occurred and they will refund the excess sorry about that

Lawyer's Assistant: What state is this in? And just to clarify, when was the purchase made?

This was in Victoria there wasn't a purchase it was an insurance claim

Lawyer's Assistant: Has anything been filed or reported?

A claim was made and my son was told to pay the excess which he did then assumed everything was in place then told today, 2 months later that the policy will not be honoured because he had accidently backed into his brothers car who lived at the same address. He asked why had they told him to proceed and pay the excess they said it was their error

I have been in contact with the insurance company and they said they are sorry I asked for that in writing but they will not do that. I asked to speak to a manager but they will not do that as that is not the process, every thing I asked for they just say that is not the way there process works, very frustrating

Hi Pearl, sorry I pressed the wrong button, lol. My name is ***** ***** live in Pakenham 3810, Victoria. My son was involved in an accident before xmas on the 19th Dec. The weather was bad and a car up ahead cut another car off which made everyone brake all of a sudden, Luke had space between him and the car in front but the car behind him was not going to stop in time and tried to swerve to miss him but still hit Luke and pushed him into the car in front. The person that hit him took off and he of course in the situation did not get a number plate reading. The lady that he hit said to him that she saw the car push him into her, so there is one witness, another 2 people also pulled over to say that they saw the car push him into the car in front, but no one got the number plate. Luke knowing he had no insurance did the right thing and got out of his car to help the lady, and he was also worried about the children in the back. They were all alright, he exchanged details, he also came straight home and then went to the police station to let them know what happened. The insurance company Aami contacted the witnesses and down the track they called Luke and told him that they had spoken to the witnesses and that everything should be fine. App 3 months later he starts getting phone calls from Aami asking him to pay them money for the damage of the other vehicle. If the person that he hit and 2 others that saw it happen said about a car hitting him into her car, can they still ask him to pay the damages. Sorry for being such a long post.
