In May, I became...

In May, I became a customer of OVO. They run through Optus. I payed $10 a month for phone and $30 a month for Data. I couldn't get the data to work, even with OVO help, in the end they told me it was an Otus problem and shuged me off. So I straight away went out and joined Optus, Since in the week I tried to get the internet working, I ran out of phone credit.

Lawyer's Assistant: Because employment law varies from place to place, can you tell me what state this is in?

I haven't had a a problem with any Optus product since the 22/5 since I joined. I'm in NSW. OVO have frequently taken money for data out of my account when, I havent used any, not even one byte!

Lawyer's Assistant: Has anything been filed or reported?

This is my first contact with anyone apart from OVO, when they said earlier in the week that the last payment they took was wrong (on Sunday) and they will refund it by now. They said on Sunday I had the direct debit button set to take money ( I tried to find that button many times but could not). They told me they set it correctly on my dashboard using their computer.

Lawyer's Assistant: Anything else you want the lawyer to know before I connect you?

I told them I don't want their services last month, but they still direct debit my account. So... No, that's it.

Dear Customer, your matter relates to telephone/internet services.

The long held rule of contract is that once the signature of a party is written on the agreement and exchange has occurred, the contract will be binding even if the party has not read the terms and conditions. However, there are limited exceptions to this rule, that would ultimately need to be argued in court.

I advise if you are not able to resolve the matter with the company, you may issue a complaint to the telecommunications ombudsman who will then investigate the same.

The alternative is that you may be able to bring a claim under the Australian Consumer Law.
