Hi, I have a...

Hi, I have a question. My friend has signed a vehicle over to be dispose of to the wreckers. I found out that the wreckers mate is going to register the car for himself and did not pay any money for this car. It is supposed to be dispose off is the owner understanding, but the man has dementia and does what he is told. Any leg to stand on?

Sth Australia and the car is about maybe over 20 years old

Police says it's a legal matter and can't do anything about it. I rang the Registration place and they said that Brian can put in a notice of Disposal in to them.

No, just what I could do to help him maybe. I am a friend, but not related. I didn't know there was a charge for this. Doesn't say anything about that.

If your friend has dementia and does not understand then the transfer is not valid.

Did they agree on a price and if so is it in writing and what evidence do you have?

Hi, He did not get any money for it, and understood that the car was going to go to the wreckers.
The only evidence he has got is the signed form on the back of the Registration paper. And a piece of paper saying... any problem he has is their (wreckers) problem.money was not mentioned at all.I cannot talk on the phone as I am Hearing impaired.Are you there Leon?Helloooooooo

My apology for the delay I had clients come in.

So the agreement was that they were not to pay for the car.

Why not take it to the wreckers himself? I cannot see what they have done wrong as your friend did not want the car and has given it to them fro free. They can do with it as they wish.

The thing is the tow truck was supposed to have dispose of it to the Wreckers. My friend could not do as they are in their 80's. Also they were not offered any money. He had 4 brand new tyres on it.
But anyone, some one else is following it up for me.

Good Afternoon

I am concerned about why your friend signed it over to them. By doing this they have transferred ownership.

If he wanted it transferred to the wreckers he did not have to transfer the ownership to anyone.

By transferring the ownership he no longer owns the car and as there was no price between them there is very little he can do. He has signed away his rights.

There is very little more I can offer you. There may be a breach of contract but your friend cannot sue for losses as he was not to receive any payment for the car.

There are no financial losses that I can find from what you have told me.

I am very sorry I cannot give you anything more positive.
