Because you have agreed to the quote and they have done the job there is a valid contract and you have agreed to it.

There is now very little that can be done to dispute the costs.

What you requested after they did the job should have ben requested before you authorised them to proceed.

I am concerned that if you take the matter to the tribunal and argue that you have been overcharged the fact you accepted the quote may go against you.

Have you had anyone else that is a plumber confirm that they would have done it for a lower price and that they are prepared to back you in any application?

Is he prepared to appear and give evidence and has he given you a figure that he says you should have been charged with a breakdown?

Have you filed a response to their action?

That is not a breach of contract.

If the agreement says that they will provide you with a details breakdown of the work and material before they do the work and they have failed to do that then you have a case there.

But if that is not a condition of the agreement you cannot raise it now.

They have provided you with a quote for the work. If you accepted it and told them to go ahead and they did the job then the contract is complete. If you then later decide that you believe that you may have been able to get it cheaper you are still bound by the agreement that you had with them you cannot change the terms unless they agree.

They warrant the work they did. The equipment they used have warranty from the manufacturers that they have to enforce.

If the material fails you sue the plumber and they join the manufacturer.

You cannot sue the suppliers of the material. Your contract is with the plumber. You can only sue the plumber and he has to join the manufacturer.

A warranty against defects is a representation communicated to a consumer that if the goods or services (or part of them) are defective, the business will:

• repair or replace goods (or part of them)
• resupply or fix a problem with services (or part of them)
• provide compensation to the consumer.

A representation will only be a warranty against defects if it is made at or around the time that goods or services are supplied.

A promise about what you as a supplier or manufacturer will do if something goes wrong with a good or service can be a warranty against defects under the ACL even if it is not provided in a formal document.

Any material with writing on it could evidence a warranty against defects, for example wording on the packaging or on a label, if those words contain such a promise.

So idk they refuse to give you the warrant details for each part they are liable for any defect they supplied the parts and did the work.

But you will have trouble not paying them when you have agreed to the price and they did the job.

Did you measure the depth? If you have evidence that it was not as deep then you may be able to argue less but if you did not measure it is your word against the plumbers.

it is not an easy fight and I am concerned it can cost you money if you lose.

Did they offer it as part of the contract?

Did it have a start date and did you start paying?

Now he is saying no?

What was the timeframe and the arrangements?

When you say half now, was that before the work started? If so why did you only pay 10%

I understand what the t& C said.

But if you agreed to half on completion and did not pay it then you have breached the agreement for instalments.
