I signed a buyers agency agreement then felt after a few days I was doing all the work and not getting much back, so I cancelled and asked for a refund and he withheld $500 from the $2899 fee. I've done some preliminary online searching of my state (NSW) laws in Australia and the NSW Fair Trading, and Real Estate agency laws and its not 100% clear but there does seem to be a cooling off period that I'm entitled too and the day whether 5 or 14 and the fact that it was signed in my home, ie internet transaction and not in his office, infers that I'm entitled to a full refund. That's not even bringing into it that I cancelled because he was not living up to his part of the deal in finding and researching ppty's for me. I was sending him all my researched ppty's that I'd done and he spent days just feeding me back what I'd already given him by putting them into a spreadsheet, but nothing new that I didn't already know....which is my reason for cancelling because after just 3 or 4 days I realised this was a waste of time and money, So I think I'm within the cooling off period but there are many variations of the same law...so its a grey area and needing advice before contacting him, ps his dad's a lawyer, but that doesn't intimidate me at all...I worked in law too, albeit as a legal secretary but still, I know my rights … read more
