Hi I am a licensed building contractor in SA. I engage other licenced contractors to perform work for me and have had a big issue with a job that my business undertook recently. We were engaged to do a bathroom renovation the client agreed to our quote and I engaged a contractor to perform the works. The progress payments were 10% deposit, another amount at completion of demolition, the client then wanted us to order some plumbing supplies so they paid us for these also and the remainder would then be due at completion of the job.
The client paid the 10% deposit, then the agreed progress payment for the demolition and removal of the existing bathroom.
The client supplied the tiles for the job.
My contractors then performed further works (satisfactory) including a screed and waterproofing and tiled the walls (borderline satisfactory) they then tiled the floor (unsatisfactory) I then did an inspection of the works. I was shocked at some of the works completed and offered to the client to repair the issues (at no charge) the client verbally agreed at the time. The next day I spoke with the client the next day and was told that she now was going to speak with other contractors and most likely didn't want us to complete the works.
To repair the job would require remove floor tiles(would not be useable again) redo waterproof, retile the floor as a minimum.
If the client engages another contractor am I liable to pay for repair costs, replace client supplied materials? And am I entitled to payment for the works that have been completed to a satisfactory standard and do I owe the contractor for the works that he has performed? Thanks
