I missed an important court date yesterday due to being incarcerated.
I was due to appear in Family Court WA yesterday where my ex is requesting urgent orders be granted by the magistrate to sell our family home. I want to buy it but he accepted an offer on the property in October last year and wants it sold. The house is in his name only but I am on a linked mortgage which means he can't settle hence he's taking it to court. The purchaser doesn't want to cancel the contract. I was granted a conditional finance approval 6 months ago.
2 days before the court date I was passenger in a motor vehicle which was stopped by police. The MV turned out to be stolen but had number plates belonging to me on it (unbeknown to me). The police have then searched for the VIN number and on doing so located drugs under the bonnet of the car, not mine nor did i admit they were mine. (16G of meth plus scales). I was found with 1G of meth on me when they searched me. I have no criminal record at all. No history. The driver has lots of criminal convictions from his past but was also unaware of the issues with the car he was driving. No charges were laid on him at all. I have been charged with stealing a motor vehicle, being in possession of stolen property, possess unlawful drug with intent to sell or supply and possess unlawful drug. My bail was refused at the police station but granted by the magistrate. I had to go to prison for 3 days whilst by 10 by 10 surety was sorted out.
As a result not only was i not able to submit my affidavits but i wasn't able to attend court and couldn't do anything about it.
I'm not sure what the magistrate did in regards ***** ***** home but I am pretty confident she would have agreed for the home to be sold as the previous hearing date i was unwell and didn't attend although I notified the other party of this.
Is there anything I can do in this situation?
