What can we do? Neighbour dispute: We own a property (1
Neighbour dispute: We own a property (1 acre) that is a flying fox colony and they are protected and we want to protect them. We have people living in the property at present who are intending to buy it and they are flying fox people and are heavily involved in the care of these creatures. We also own another property next door almost and the neighbour that owns the property adjoining both of us is on 1 acre also but also part owns the land beside it that is bigger with his parents. He has made it his mission for the past 12 months to try to disperse the colony of bats and to intimidate us. I am so scared we have put our other property on the market and I have moved away leaving my partner there until it sells. The issues. He (the neighbour) burns 2 incinerators extremely close to the fence under the trees, fills them with accelerants and creates toxic smoke that has filled both our houses up (100m away) to a point we have to sit outside. He revs up and down the fence line in an old car he has now taken the exhaust pipe off and does burn outs just sitting beside the house on his side and revving and burnouts continuously with noise, fumes and dust storms filling up the house. He bangs metal for hours against the fence, he yells he can do whatever he likes its his property. He has previously threatened to burn the place down and our place if we ever report him. We called the police twice and fire brigade when he used a blower vac to send a massive fountain of embers into the property trying to set it alight. I am terrified of this man and so is the new people (who may end up leaving and we lose a sale due to this mans behaviour). I have reported him to council now for the toxic smoke and to the Dept of Environmental Services for his attack on a protected species (they have opened an investigation and want more footage and will do something in approx 6 months time as they want to take it to court and want as much as they can to have him charged - also they are re-listing the camp for protection). Really? I have acomplicated case. My partner wants to seperate. We own a property, 250a, mostly native bush land. Half of it belongs to his parents, who built a work shed, where my father-in-law, brother-in-law and ex-partner make guitars. My ex-partner and I own half of the land, 4 sheds and an old farm house. We paid for it all together $310.000 13 years ago. But now it's only worth between 250.000 and 290.000. My ex wants me to leave and move to town. He wants to pay me out. I used to work together with him as partner, doing the book work. We used to share the income of the guitars. But he wants me out of the business now, so I basically lost my job. I have 2 casual jobs now, but they pay onle between $500 and $1000 a months. We have savings, about $80.000 and shares, about $16.000. Our super is not much, about $16.000 each I think. With my income I can't really pay rent in town, which is at least $250 a week. I don't want to use my payout of the property for rent, because it will be gone in a view years. So I would prefer to stay in our old house, at least until I find another job. I don't want him to pay me out of the property, because it might be a good retirement investment.
