Hello.
My husband is executor to his father's will. There is a codicil to the will that states:
"In reference to clause 4 of my Will I declare that my daughter (named) be entitled to remain living in my family home and for my executor to withhold any sale of the property for a period of five (5) years after the date of my death on a rent free basis provided she attend to the payment of all outgoings such as council rates, water rates, insurance and keep the property in a good and habitable state of repair."
Clause 4 says that the whole of the estate be given to trustee upon trust to sell call in and convert to money etc and divide between beneficiaries.
The property in question is in the state of NSW.
Please advise the following:
1. If the daughter living in the house at present wants to move out within the 5 year period, can the property then be sold or does this daughter have have the final say whether it can be sold within the five year period even if she is not living in it?
2. The executor has already lodged an intention to apply for probate form. Can probate actually be applied for when this codicil exists?
3. Are all beneficiaries still "presently entitled" to the property for tax purposes? (or doesnt that matter?)
4. There are other small assets (shares and cash). Are all beneficaries (who are all named as equally beneficiaries in the will) presently entitled to these assets?
4A. If probate can be granted in these ciscumstances, how long after probate is granted can the shares be sold and cash distributed?
There are 8 sisters and brothers and all get on very well.
