IMPORT LAW QUESTION
Hi,
I am in the process of importing a container of go karts into OZ and have a problem. The container was flagged and I had to provide bank documents and invoices pertaining to the container. The abn I was using was attached to a company that I discovered had been deregistered in 2012 and the associated abn was cancelled on the day customs received these documents, presumably because it was attached to a deregistered company.
i paid for the items using my personal bank account.
However, customs must have felt that the value was very low as they have made an examination request and now the container must be transferred to a 77g depot. I need to act now as the container has just arrived. I am required to attend an inspection where they will unpack the container and open the items. I still have not filled out the paperwork to send to the examination team who will inspect the container so there is still time to change the invoice from my deregistered company to my personal name, perhaps with a letter explaining this. Or possibly I could present this on day of inspection if needed. My primary concern is getting this done quickly and having my items released.
Also, the permit I obtained 1 year ago to import these go karts is under my personal name. I am concerned that i will have problems keeping the invoice in the company name as they may say the import approval for these go karts only applies to items in my personal name.
I am looking at a few options. I could apply for a new abn and/or business name and then have invoice name changed to this before resending to customs. Or could put into my name, with the intention of starting a new business name as yet unspecified.
I am also concerned as to what my liabilities might be if they feel the value of the items was higher or the liability in company vs private names.
