Hi there, I bought my property (which I also occupy) back in 2012 (8 years ago). Earlier this year I received a notice from a small legal firm titled "legal notice" stating that my neighbour had decided to build a granny flat on his property and it had been deemed non-compliant by the council due to boundary distancing requirements. Further, the notice goes on to say that the neighbour is claiming encroachment with the fence being too far across on his property (a fairly substantial 400mm). Moving the fence across would make his granny flat compliant. The notice also stated that the survey had been completed and the report stated the 400mm referenced above. After I responded to the lawyer to provide the documentation, I discovered that there actually was no survey completed. My main query is, assuming a survey was completed showing encroachment and given that I purchased my property as is, and any reduction in size would be a slap in the face to me, do I have a foot to stand on in terms of protecting my investment? My secondary question is, it is becoming more evident that the lawyer was deceitful in order to strong arm me to give in. He has now confirmed that there is no such report confirming the 400mm encroachment making his claims false. Can I take any course of action here to expose such an act? … read more
