my wife took an avo against me but root course was my son's aggressive approach, attitude and disrespect towards me when I stepped on my driveway after returning from overseas after 3 months with my friend. My friend and my son had some heated disagreements and arguments regarding my son's reactions towards me which I defused by pushing both my son and my friend away and did push my son against the garage door but with no intention to cause any harm. this is also was witnessed by my son's friend who came to pick my son for dinner. my friend suggested to my son and his friend to go away for dinner and they left. I went inside to have my shower and my friend left but after 1/2hr my son return with his friend and my younger brother and invited my friend to resolve the issue. I greet my brother and told I will join them after finishing my prayers. My brother and my friend tried to calm down my son's aggressiveness and succeeded after 1/2hr, told him to leave me alone and go for dinner and they left. when I came down I saw my son and his friend sitting down, so I brought the presents that I bought for him and my wife and handed to him by greeting him my son, when he replied that him not my son and still have no respect for me. this is when I told him that this is the case the he can leave my home, so he called my brother again and told that I started again, my brother asked my son to hand the phone to me and I told him what happen, so my brother invited me to his place and I left. meanwhile I haven't met my wife yet.
when I return at around 10pm I saw my wife, my son and his friend sitting down. I greeted my wife and asked if she return from wedding because of her dressing and she said no it was a pre wedding ceremony. I told them that I was going to bed and was just half way on the stairs when my son called and said why I was again running away without resolving what happened in the afternoon in front of my wife. my son and i came to a disagreement then i asked my son's friend to please clarify our disagreement as he was present at the scene. My son's friend told me that he doesn't want to get involve in our family matter, this is when i asked my friend's son to get out my house if you don't want to clarify and resolve the issues and when he didn't move i asked him again with my high raised voice and my wife and son stood up to defend him, so i told all 3 to get out my house, this is when my wife told me to get out as this is also their house and told me that she will call the cops and started dialling. i said this is enough go ahead and call the cops and lets see what happens while i was walking towards the main door and got out and my wife, my son and his friend followed me out. my son's attitude was really aggressive towards me and was like about to get into physical with me and trying to get loss from my wife's grip, i told him if he really want to get into a fight then i m coming, as i took i step towards my son my wife screamed so loud while on the phone with cops and i stopped when i heard the cops siren, my wife, my son and his friend run inside the house while i went onto the road side to stop the cops car and within second 4 cars came and all officers run towards the main door while 1 officer was talking to me and when i told him that it my home and i am the owner, the cops asked me to turn around and handcuffed me, i asked the officer why if i haven't done anything. 6 officer came out and said there is nothing and left leave to 2 officer to deal with the issue, both officer went inside and i don't know what was said, the officer who handcuffed me came and removed the handcuffed and i told him what happened and i was just asking my son's friend to leave my house when argument broke, my behaviour was not fearsome.
my brother was called by my son arrived while i am still outside. One of the officer came out and told me that i can't stay here anymore and my wife has taken the AVO and asked me to collect my stuff within 1 minute and leave. i said where will i go this is my house, but the officer said i can't and have to leave, so my brother asked me to get my stuff and follow him to his place. Since then the interim order is in place and the court gave a mention date. My brother and my friend who gave me temporary accomodation until 17th Dec for 1st court hearing now told me to leave as they can't provide anymore
support. i have tried many time to let me go and sleep in my home but failed and now sleep in my car and my saving money is running out and i am also unemployed since april this year after 23 years of service. can't find a job also. please can you help and assist. Jitendra Prasad
