The court, you are right, looks at the best interests of the child. They don't focus on the marital status of the parents. The courts prefer ongoing substantial contact with both parents whenever it is possible - and good for the child. In situations where Dad hasn't played an active role, the courts "take it slow". They'll start with supervised visits if necessary, then day visits, then one overnight, then alternating weekends. Your daughter can't refuse them, but she can ask the judge to consider the child's feelings. Judge's will consider them based on age/maturity/intelligence, and 6 is young, but an interested judge may ask.Alternatively, you can have a counselor work with her to determine her level of comfort as this is something the courts would take into consideration.

That's because some kids (teens usually) want to stay at the cool parents house (no rules) and so the judge asks if they would abide the order and stay at the non-cool parents house.

That's a decision for the judge but if the child is very distressed they would likely order family counseling and try to find the cause of the problem.
