I was served with a traffic infringement notice as a result of an event on April 2. I requested that I be allowed to view the ICV which was done. the video was bisarre and seemed to have been cut-and-pasted but it showed me turning with a red signal and with a pederstrian crossing against a greenman. I entered a plea of 'guilty but with an explantion' however the magistrate rejected my plea and demanded i enter a 'guilty' or 'not guilty' plea. I remembered I turned on a green arrow with red light and was at a loss how to account for the ICV record as it made no sense in terms of the TCS sequencing. I then submitted at Balmain Court a subpoena request for a copy of the ICV and prior to this being delivered I received a telephone call from the Petersham Highway Patrol Station inviting me to view (for the second time) the ICV on a large screen television. The invitation was from the officer who originally issued my infringement notice. When I arrrived I was met by the officer who had shown me the ICV the first time. I wished to construct a timeline of the critical events but he simply ran the video back and forth. After 30 minutes of this the isuing officer arrived and made an excuse for being late but said little. It was suggested to me that I ring them the following week to drop the matter and not proceed to the court hearing. Yesterday I attended Balmain Court to pick up the subpoened ICV. I was shocked to discover it is entirely different to the ICV copy shown at the Petersham Station, the signals are reversed and my vehicle passess through the crossing while the signal is green and the PCS is red, in other words, if am reading the situation correctly, the patrol officer should not have issued me with an infringement. The trial hearing comes up on November 30, 2012. I am a retired pensioner and have sought legal aid but it has not been of much help and I would certainly not have got this far with a lawyer, it has required so much work on my part.

My question is this: should I report the matter to the PIC or to the NSW Ombudsman or both. It is difficult to prove, I have a copy of the true ICV, but I imagine the highway patrol would have deleted any copies of the falsified ICV which they used to show me. I now expect that Constable Benjamin Chapman will not appear at the hearing but until then things will remain uncertain.
