I am in the middle of a property settlement for divorce. My ex husband has put it on me to pay the $458,000 loan secured against my property that was purchased with motor vehicle accident money in 2004. I was then injured again (spinal injuries) in the mining industry 2013. Of the $458,000 loan my ex husband has admitted spending $336,000 of the loan, I've spent $122,000. I am now classified as Total Permanent Disability and am unable to work in a typical way to even repay the debt. He earns $200,000 per annum as a full time mining employee. My ex husband is saying I am the loan owner as my compensatory property is security for the loan however, he is the financial component as, I was not working at the time the loan was taken out due to my injuries.
