Dear Sirs
I have been employed under an Australian contract for Panalpina World transport in Australia, they being a part of the global Panalpina group. Before coming to Australia I was employed in Hong Kong and since 2002 have held the position and title of Regional Security Manager Asia Pacific and China.
My job until this year has involved extensive travel visiting the many countries I over see. When i came to Australia initially it was under the support of the local company who wanted me to take on a local claims handling function in addition to my Security functions. I agreed to this as i wanted to come to Australia. After arriving this extra function was withdrawn due to Corporate instructions.
For the past two years in 2010 and 2011 I have had on average 15 overseas trips each year, but this year I have had only one. I have found it very difficult to do my job as I cannot travel and I have become bored.. effectively my job has become redundant because of not being able to travel.
In recent week s the group had laid off many senior persons as a cost containment measure.
I have now been laid off using a 3 month notice clause in my contract. They refused to tell me the reason, but given I have not been allowed to travel and have not had much work to do as a result, they have effectively retrenched my position to save money as the limited work I was doing could easily be redundant
I am 56 years of age and had an annual salary of over AU$ 210,000 and worked under a local contract for 984 days.
They have refused to even give me an reference letter but will only give a certificate of service
Although they have not declared it as redundancy, all the indications and evidence support this and i would like to seek advice on whether I may have a claim for redundancy compensation?
