THe law states that the fence must be reasonable in the circumstances.
If one fence is suitable (colorbond) but the other fence (timber) is more expensive, then your mother is only obliged to pay half of the amount for the cheaper (colorbond) as it is suitable.
So the neighbors can build the timber fence, but must pay more for the fence. Secondly, if they are that stubborn to build the fence then ask for her payment at a later date = it will be too late. The law is that arrangements for payment must be made BEFORE the build.
Options:
1. Do noting, let them build the fence and hope they dont seek an order before it is built.
2. Give the ok to build the timber fence and pay for half of what a colorbond fence would be.
3. Built colorbond fence and pay half.
