The issue is, someone in your position would have looked at the relevant searches before signing a contract.
Frankly, the law says that if one was to buy a property, they would have looked at all issues in regard to the matter.
Because they were silent on the matter, means nothing. They have not mislead you in anyway.
Notwithstanding, i would try to ask for the deposit back, the issue is, they can claim the above and not give it back.
