I borrowed $350 000 from Bankwest to build a new home. The cost of the build is $450 000. We were therfore required to provide $100 000 to Bankwest which was sitting in an account earning interest with Bankwest. When the first progress payment was due the bank asked for the $80 000 ( we had previously paid up front $20 000 to the builder) being the balance of the $100 000 into the loan account. The first progress payment was made by the bank of approx $63 000 out of our $80 000. My issue is that the remaining money of approx $18000 is sitting in the loan account and has been for close to two months and is not earning interest. The Bank advises that it doesn't pay interest on credit in loan accounts. My argument is that the loan is not in credit. It has not been used to date. The credit is my money demanded by the bank and whilst I understand they need to make sure we pay the $100 000 for the build I think it is very unfair that they hold my money without paying me interest. The bank argues that the money is part of the loan and therefore they don't pay credit interest. My argument is the loan of $350 000 is separate and I am entitled to earn interest om my money held by the bank. I know I am only seeing it as from what is just "fair". can you please advise on what is legal?
