I have submitted my letter of resignation dated 1 June 2012,

Hi,

Salary in lieu of notice period means the payback of $Xxx due to the unfulfilment to the term of employment agreement.

I am working as a manager so the company require me to serve 3 months notice period. It is stated very clearly in the letter of resignation, to request the company for early release, with last day on 15 July 2012.

The company aknowledge and accepted my resignation.

But they are now requesting me to payback $ 9000 for the period 16 July 2012 to 31 August 2012.

I felt that unless the company cannot release me per requested date but I insisted. I should payback.

Now, base on mutual agreement, notice period can be waived. As such, no payback is neccessary.

Letter of Acceptance ( Received from Employer dated 5 June 2012)

We refer to your letter of resignation dated 1 June 2012.

Please be informed that your resignation has been accepted. You have requested to leave the company on 15 July 2012, before the offical last day which is 31 August 2012. Arrangements will be made for pay you up till 15 July 2012.

Your annual leave entitlement calculated up to the last day of service is 7 days.

Accordingly to our employment agreement, you are required to serve 3 months resignation notice OR salary in lieu of the notice period. In view of that you are required to pay the Company $Xxx by 9 July 2012.

The Employment Agreement:

Section 11 Termination & Termination of notice period

1) This Agreement shall be terminated by either the Company or the Employee by giving the other a written termination notice on their intention to terminate this Agreement with the required termination notice period or payment in lieu of notice in accordance to clause 11 (2) below:

2) Confirmed Managerial position and above, 3 months' notice or 3 months' salary in lieu of notice.

3) In the event where Employee terminates this Agreement without giving the proper written written termination 11 (1) and 11 (2), the Company shall deduct from the salary due to the Employee, the sum required to pay in lieu of the termination notice.

Then, what about the validity of the contract? There is no letterhead on all the pages of the contract....

Thanks. Because of your advice, the employer has decide to waive my notice period and I am not require to payback the salary in lieu of SGD $8500.
