We sold our business to a guy and he ran it from our property. He also loaned us $100,000 for a business venture for 10% p/a. We worked for him for 10 months and we had a verbal agreement for him to pay rent at $300.00 p/week and pay us for our work and services. As he pleaded poor and the money was not there to pay us, he verbally agreed and we accepted that when he becomes financial and the business builds up again, which it did, he would then pay us what he owes us. He has a caveat on our property for $100,000. After 10 months of working for him, for which we have given him invoices, he then abandoned the business overnight and we are now suffering very badly from financial hardship. We now have the property on the market but he still has a caveat on the property. He has left his machinery on our property which we could sell to recover some of the debt he owes to us. We want the caveat removed because, including interest, he now owes us almost what we owe him. He took us to the district court to try to get a judge to make a summary judgement but we had a very good counter-claim against him. The judge did not make a judgement as he knew the circumstances were not simple. This person then did not take it further. Can we sell his equipment to recover our costs? We do not have the funds to take him to court and it would be a district court matter as the amounts involved are over $75,000. We have someone interested in purchasing our property but we do not want his $100,000 to go to him as he still owes us the funds. We would be happy to call it quits if he handed the machinery over which we could use to gain an income, or sell. What is the best way to proceed? It is a long drawn-out process to try for abdonment and he would then just come to our shed and get the machinery and we have nothing over his property to get the money that he owes us. We simply want him to take the caveat off and take his machinery and call it quits. How can we go about this?
