Hello Just Answer Team, I have some questions regarding Australian Superannuation Law,
I am going through an ATO audit at the moment regarding a SMSF which was formed as a Deposit Account in 1996. I have just been through a 3 1/2 year marriage settlement (with helpful advise from Just Answer), my questions relate to a property I have owned and also operated my business from since 1984 which was bought by the SMSF in 2001, the reasons for this being done has always concerned me, I now believe the Tax adviser and my wife had their own reasons for transferring the property from me. I of course signed all the documents to allow this to take place but never instigated the transfer. The Tax audit is now asking for outstanding rent to be paid back, The total rent paid per year was always dependent on the cash flow of the business at the time as it was more important for the business to survive. There wasn't a Trust Deed recognising the property until 2010 and never a lease agreement in place. The fund had been audited since 2001 but a query regarding the rent was never raised until the separation in 2009 by my wife and the Tax Adviser who had taken her side in the matter. My questions are 1:Should I be liable to back pay the rent from 2001 , 2: Should I pursue the true reasons for the property being put into the fund (although I had asked questions leading up to the court hearing but have found that the other parties are not truthful. 3: Can the property be removed from the SMSF on the grounds that it was set up illegally would there be taxes to be paid back. Your help would be appreciated.
