I have a client who was involved in a forestry scheme and
I have a client who was involved in a forestry scheme and has now received a Filing Confirmation Notice from the County Court of Victoria demanding payment of a loan which he was advised by a legal firm not to pay. He has been given 21 days to pay over $100,000, which he does not have. He was advised by the solicitors in the class action not to pay as they felt that they would be successful in getting the loan from Willmott Finance voided. Annoyingly, he signed up to invest in this project through Willmott Finance who went into receivership within the next 3 months. Surely they would have been aware of their financial position and should not have proceeded with the investments as they were trading insolvent. Many clients now find themselves in a similar situation based on bad advice from these solicitors. They have also had their clients sign waivers to exempt them from legal action if the class action against Willmott Finance and others failed.
