If he knew that she had the knee problem then he owes you a greater duty of care than the average employee without any problem. He cannot refuse your claim because he knew you had a knee problem.
You have a right to file a claim for workers compensation as the job has caused and aggravation of the problem.
You do not have to prove that workers caused the injury. Your doctors report is the evidence you will rely on as to the cause of the injury.
If your employer refuses to accept your claim then I suggest you contact us the Law Society of Queensland and get a referral to a solicitor that practices in workers compensation.
Most of the solicitors will do with the work on a no win no fee basis.

What state is this in? And how old is the truck?Customer: I attended a pre employment medical test and the job offer was taken away. They said it was because of my medical exam. The Medical Centre and the Mine have refused to give me the results of this examination. My husband was told by his boss that I did not get the job because I had a knee reconstruction over 20 years ago and because I have mild arthritis in my thumbs due to an accident. I do not take any medication anymore for the arthritis. I work on a cattle property and am very active riding horses while mustering, fencing, giving cattle needles for worming and ticks. Neither of these ailments have caused me not to be able to do any job on my property. I certainly have no trouble driving our 6 tonne cattle truck loaded with cattle. How can I retrieve my medical records and is this a form of discrimination as my knee or thumbs do not hinder my work st all.
